THE APPLICANT REQUESTS THAT:
1. His original Promotion Recommendation Form (PRF) that met
the Calendar Year 2011B (CY11B) Line and Health Professions
Lieutenant Colonel Promotion Board be replaced with a substitute
PRF.
2. The corrected record be considered by a Special Selection
Board (SSB).

THE APPLICANT CONTENDS THAT:
His PRF did not sufficiently reflect his level of
accomplishments and was not a true and accurate representation
of his actual record of achievement. The substitute PRF
contains substantive additions to his record of performance
which were previously unknown and not accounted for in the
original PRF.
The unintentional oversights materially altered and unduly
influenced the adjudication processes used in making assessments
and determining rankings within the wing.
In support of his appeal, the applicant provides a letter of
support from his former commander and a substitute PRF for the
CY11B promotion board.

STATEMENT OF FACTS:
On 1 Oct 03, the applicant was promoted to the grade of major.
The applicant was considered and nonselected by the Calendar
Year (CY) 2010 (CY10) USAFR Line and Health Professions
Lieutenant Colonel and the CY11 USAFR Line and Health
Professions Lieutenant Colonel Promotion Selection Boards. The
CY10 board convened on 14 Jun 10 and the CY11 board convened on
13 Jun 11.
By letter, dated 23 Aug 11, the applicant was notified that In
Accordance With (IAW) Title 10, United States Code (USC),
§14506, on 1 Mar 12, he would be automatically transferred to
the Retired Reserve because of his second deferral for promotion
to the grade of lieutenant colonel.
On 1 Mar 12, the applicant was transferred to the Retired
Reserve, awaiting pay at age 60.

THE AIR FORCE EVALUATION:
AFPC/DPTS recommends approval. DPTS states that IAW AFI 36-
2406, Officer and Enlisted Evaluation System, paragraph 10.3.3.,
the applicant provided a substitute report signed by the
original Senior Rater. The facts being presented to the Board
are from the original chain of command substantiating the
applicant's case.

APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 13 Dec 13 for review and comment within 30 days.
As of this date, no response has been received by this office
(Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to
demonstrate the existence of error or injustice warranting
corrective action. Having carefully reviewed this application,
we agree with the recommendation of the Air Force office of
primary responsibility and adopt the rationale expressed as the
basis for our decision that the applicant has been the victim of
either an error or an injustice. Therefore, we recommend the
applicants record be corrected to the extent indicated below.
4. The applicant's case is adequately documented and it has not
been shown that a personal appearance with or without counsel will
materially add to our understanding of the issues involved.
Therefore, the request for a hearing is not favorably considered.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air
Force relating to APPLICANT, be corrected to show that the AF
Form 709, Promotion Recommendation Form (PRF), prepared for the
Calendar Year 2011B (CY11B) Line and Health Professions
Lieutenant Colonel Promotion Board be declared void and removed
from his records and the attached PRF, reflecting in Section IV,
Promotion Recommendation, #9 of 14 eligible;
and in Section
IX, Overall Recommendation, Definitely Promote," be accepted
for file in its place.
It is further recommended that his record, to include the
attached PRF, be considered for promotion to the grade of
lieutenant colonel by a Special Selection Board for the CY11B
Line and Health Professions Lieutenant Colonel Promotion Board.
